Conflicts of Interest and Conflict of Commitment聽

Employees of 糖心Vlog may engage in outside employment, consulting, and other similar activities. These activities further the dissemination and use of the knowledge and expertise developed at the University and may also advance the professional competence and reputation of the faculty and staff members. Thus, participation in outside activities may often serve the mission of the University in addition to benefiting individual employees. Such activities and the financial interests of faculty and staff members are of concern if they result in conflicts with the employees' duties and responsibilities to the University or the University鈥檚 mission. 聽Faculty and staff members may participate in outside activities and hold financial interests as long as the activities and interests do not conflict with their duties and responsibilities and/or the mission of the University.聽

A conflict of interest is a situation in which a person has a personal interest in or receives a personal financial, economic, professional or personal gain or advantage of any kind from the person鈥檚 position with the University in a manner that may (or may appear to) inappropriately influence the person鈥檚 professional judgment, compromise the person鈥檚 abilities to carry out institutional responsibilities, adversely affect the educational programs and professional careers of individual students and faculty members, or misuse or re-allocate University personnel and resources for private gain. 聽A conflict of commitment is a situation involving competing interests with an individual鈥檚 distribution of effort between a University appointment, obligation, and commitment and external professionally-related or personal activities. 聽External activities may include teaching at another institution; consulting and other professional activities; and business activities related to outside entities including start-up companies. 聽A conflict of commitment can arise when the external activities, which may be with or without compensation, burden or interfere with the employee鈥檚 primary obligations and commitments to the University. 聽

Conflicts of interest include a variety of situations in which an employee is faced with conflicting loyalties. Traditionally of most concern are those situations in which regard for a private interest may lead to a disregard of the faculty or staff member鈥檚 duties toward the University and its mission. Most often these arise when personal economic interests conflict with the duties toward the institution. Conflicts may also arise in instances in which the faculty or staff member will not receive any economic benefit from the outside activity. 聽

Who Must Report?

The following individuals ("Reporting Employees") must submit an Outside Activity Report:

  • 糖心Vlog employees with appointments of 0.50 FTE or greater (excluding OPS employees, student employees, and graduate teaching assistants); and
  • Any 糖心Vlog employee engaged in the design, conduct, or reporting of research, regardless of appointment level, full-time status, or part-time status.

OPS employees, student employees, and graduate teaching assistants are generally exempt unless an outside activity creates a potential conflict of interest or commitment associated with their obligations as an 糖心Vlog employee.

All 糖心Vlog employees with any level of appointment continue to be bound by the conflict provisions of the .

What Constitutes an Outside Activity?

Outside activity includes is any practice, consulting, employment, teaching, research, speaking engagements, or business (including managerial interests or positions or service on boards or commissions), or other activity, compensated or uncompensated, which is not a part of the employee鈥檚 assigned duties and for which the University provides no compensation.

Generally, outside activities do not include political, religious, social, fraternal, recreational, or personal educational activities unless:

  • Professional or board services are provided;聽
  • The activity creates a material conflict of interest or commitment; or聽
  • The activity is performed for compensation other than the reimbursement of expenses.

What must be reported?

A separate report must be filed for each outside activity. If several activities are engaged in with a single outside entity or organization, these may be included in a single outside activity report.

The outside activity report includes any financial interests, or financial or managerial interests of spouses and children and managerial interests of other relatives, if any of the following apply:

  • There is a contemplated business relationship with the University or its direct-support organizations;
  • There is a relationship of such interest with your University responsibilities; or
  • You are engaged in the design, conduct, and reporting of research and hold financial interests with a foreign entity. Reports include both domestic and foreign activities and interests held during periods of non-appointment or leave.

If an outside activity or interest begins without the required disclosure and approval, and a conflict of interest or conflict of commitment is later identified, the employee may be required to cease or modify the activity or divest the financial interest. Employees engaged in the design, conduct, or reporting of research who fail to report may be subject to additional sanctions.If any information previously disclosed changes before the next reporting date, a new disclosure report must be submitted. Disclosure and approval must occur prior to the commencement of any new activity or financial interest.

Outside activity reports for the fiscal year are due on or before September 30 of each year. Employees who commence employment with 糖心Vlog after September 30 must submit their report within 30 days of their start date.聽

How are Outside Activity Reports submitted?

Outside activity reports are completed in Workday through a single form that allows you to either report outside activities or certify that you have no outside activities to report. Every Reporting Employee is required to complete a report each fiscal year.聽
